Annise Parker

Houston is the first large American city to elect an openly LGBT person Mayor. This fact is pointed out in publications such as The Economist. Why shouldn't Gays and Lesbians and Transgenders be accepted in leadership roles?

This mayoral campaign was won despite an attack by the religious right a-la Hotze, and despite the fact that Annise had less money than the other candidates. But she had enthusiastic volunteers in spades. This store of psychic energy did the trick.

Annise Parker's inauguration will be held January 4th, 2009. Voter turnout was low, but, the people who cared about any or all of the candidates or issues showed up at the polls. (This was a stealth campaign. Apathy is the norm in the US.)

Parker's sexuality did not become an issue until it was brought up during the runoff election. This was a non-issue for over 50% of the voters who cast their ballot for Annise Parker.

Now all we need is protection against employment discrimination, the end of plebiscite ballot initiatives that strip us of our rights, and a supreme court in California with integrity.

Musings About Hotze

hotze aims for moving targets... Click on the previous link to read about how this arch conservative is targeting Democrats that are too liberal. Steven Hotze is sending out e-mails to recruit conservative Republicans. (Conservative is a misnomer.) I can quote this blog article, by John Cobarruvius and Martha Griffin, as saying that the Democrats that are endorsed by this coalition of the religious right all have the following points in common:

* anti-gay
* anti-affirmative action
* anti-choice
* anti-public education

The Democrats endorsed by Hotze are old-school Blue Dog Democrats. Not the kind you take home to mother, not the kind with ideals. They don't believe in much of anything other than getting elected. Texas needs leadership with vision now more than ever.

Steven M. Hotze, M.D., president of Conservative Republicans of Texas, personifies what is the worst in Texas politics today. Their agenda is one of destroying the results of other people's hard work: making Texas more livable for all of us. These are the politics of destruction.

The Conservative Republicans of Texas are inserting themselves into the Houston Runoff election in December, the runoff election between Costello and Derr, and future statewide races. Their goal is to pick off the weaker candidates like an oportunistic gazel.

The success of Annise Parker is like blood in the water for the hungry sharks. Lukily, Annise is an avid swimmer. Annise is swimming against the current. But the tide of politics is changing in Texas.

Like the moon's effect on the oceans, the antipathy for Obama can be felt here in Texas. It is a downward tug for an exhausted swimmer to fight against. There is a politics that feeds on negative energy. And it is swirling around like Ike near Galveston.

Important Political Developments

Read this Off the Kuff article on anti-gay rhetoric being directed at Annise Parker, who would be the first openly lesbian mayor of a large American City.

The social conservatives are mobilizing resentment, to take a phrase from Jean Hardisty and her excellent book of the same title.

The Off the Kuff article by Charles Kuffner talks about the socially conservative Houstonians. "...planning a campaign to discourage voters from choosing City Controller Annise Parker in the December mayoral runoff because she is a lesbian, according to multiple ministers and conservatives involved in the effort."

CAUCUS STATEMENT ON THE AFRICAN-AMERICAN NEW AND ISSUES ARTICLE

comments regarding a recent article in the African-American News and
Issues:

“In an article in the African-American News and Issues leveling baseless attacks against City Council Member Sue Lovell, publisher Roy Douglas Malonson made multiple statements that were untrue, including some about the Houston GLBT Political Caucus. If the intent of the piece was in any way related to journalism, Mr. Malonson could have easily gotten the facts straight with a simple phone call or e-mail. Mr. Malonson made no such attempt, and it is my understanding that none was made for others mentioned in the article, including the subject.'

Annise Parker Wins Final TV Debate

Houston, TX – Annise Parker completed her string of debate victories last night by decisively winning the fourth and final mayoral candidate TV debate.

Facing three of her opponents on Channel 11, KHOU-TV, Parker demonstrated her superior knowledge and experience as the only candidate with clear, concise answers to questions from the panel of four reporters.

On the question of adding police cadet classes, Parker said she would bring into the department state-certified graduates of other programs, such as those at Houston Community College.

Asked how the candidates would increase recycling, Parker pointed to programs she’s helped create that have already increased recycling: single-stream recycling, separate pick up for green organic heavy trash and recycling programs at Houston’s sports stadiums.

On the issue of flooding in Houston, Parker explained she would do a watershed by watershed analysis of drainage problems and begin tackling the problem.

To the question of what have been current Mayor Bill White’s biggest mistakes and what would you do differently, Parker said White should not have used borrowed money to pay current pension obligations, he should have brought more stakeholders into his decision-making and he should have used more economic incentives to bring businesses to Houston, which Parker said she would do.

Asked about the Metropolitan Transit Authority, Parker said she would clean house with a new Board and new administration, have her transition team look closely at Metro’s books and require Metro to post its budget and meetings online.

On the question of solving problems women have in the Houston Fire Department, Parker said she would resolve the current harassment case, recruit more women and establish mentoring programs.

None of the other three candidates could match Parker for specific answers to the tough questions. As with the previous three TV debates, Parker was the clear winner – capping a week of events that demonstrates her momentum moving into the final week of the campaign. The day before the debate, Parker announced the endorsement of State Representative Garnet Coleman – a powerful voice in national, state and local government and a particularly key endorsement in the Houston mayor’s race. And the Houston Chronicle reported that Parker is outspending her opponent Gene Locke on television and is winning the social media campaign with more supporters than all her opponents combined.


As Houston City Controller, Annise Parker directs Houston’s financial investments and manages billions of tax dollars. Her independent audits of city departments and programs have rooted out waste and saved the city money that can be used for priorities such as police, after-school programs and economic development. A businesswoman and neighborhood leader, Parker served on City Council for six years. She spent 20 years in the oil and gas industry before entering public service.

Friends, take a look at the truth about Annise Parker
Fiscal Conservatives for Annise Parker

I'm hearing Gene Locke is going on right wing radio - KSEV - today to tear apart Peter Brown. That is probably because Locke looked down last week and noticed Brown had wrenched the pincers from his hand and was beating him with both African Americans and Republicans (according to the Houston Chronicle Zogby poll). I'm sure that poll gave some of the business organizations who endorsed Locke pause for thought as they had been promised by the Locke campaign that he was a sure thing with his winning strategy of getting 80% of the African American vote along with the Republican vote. My sources tell me, some of those lobbyists are now panicked that they are backing a guy that may not even make it into the runoff.
Who is the Best Candidate to Lead Houston Through Tough Economic Times?
This got me to thinking. Earlier this year, a group of political insider friends and I started watching the mayoral race with an eye as to who would be the best person to guide Houston through the coming tough financial times. This was before the budget situation was revealed to be as bad as we later found out it was, but we knew it was headed in that direction. We all knew Annise Parker's track record - smart, competent, calm, hard working, consistent - but what about this Gene Locke guy, with his business connections? Did he have the right experience, skill set and connections to be the smart choice? As time went on we became concerned about pay for play from Locke - and too many promises made to too many insiders behind closed doors that got leaked out - promises that would line the pockets of his insider buddies, but would not be good for taxpaying citizens.
So, I decided to round up the facts about Parker that make her the choice for mayor for fiscal conservatives - the only candidate who is ready to lead the city through tough economic times.

Parker Has a Proven Track Record of Saving Taxpayer Dollars:

* Parker implemented city audits that uncovered millions of dollars of waste and fraud.
* Parker renegotiated the interest rates on bond debt, saving the city $80 million dollars.
* Parker cut her own city department budget by 2% when she first got in office.
* Parker recaptured charges for non-city of Houston waste disposal in the city landfill, saving the city $2 million.
* Parker implemented an automated interactive voice response to handle 10-digit police calls, saving the city $1.2 million.
* Parker eliminated paper paychecks for 21,000 city employees, saving the city $1 million.
* Parker consolidated motor vehicle reports into one office, saving the city $300,000.

When Parker makes promises on the campaign trail about being fiscally conservative with taxpayer dollars, it's because she has already walked the talk - she has a proven track record at City Hall doing what she's promised to do more of when she is mayor.

Brown and Locke Won't Show You the Money
Her opponents, on the other hand, are making empty promises. I thought it was very telling in Locke's Off the Kuff interview, that when Kuffner asked Locke that while his promises of putting more police on the street and giving them more advanced technology sounded great, how did he intend to pay for those initiatives, Locke answered, "I think we are still working on various models." That's not a good enough answer for a mayoral candidate in the fourth largest city in the country six weeks before election day. If you are going to make promises, tell how you are going to pay for them in these tough economic times.
Peter Brown is promising more police on the street, as well, without telling how he will pay for them. And, he's promising a beefed up Real Time Crime Center, which sounds good but looks like it will cost millions if it looks anything like what he has in his ad. And, he's got a blueprint that will involve doing more with less. He's very consistent with that message, but what does it mean exactly?

Annise Parker the Best Choice for Saving Your Tax Dollars
I'll have more in a followup post on Parker's policies and how they are the fiscally responsible ones in these tough economic times. Clearly, Parker has a track record of saving taxpayer dollars, finding efficiencies and eliminating waste. She is not the candidate whose records show he is charging the city (your tax dollars) $640/hour to represent Metro, the Sports Authority and the Port of Houston. She is not the candidate who is using his wife's personal fortune to finance his campaign to the tune of a $1.7 million loan.
While Locke and Brown are squabbling over who deserves the Republican vote, Annise Parker is rising above that fray, looking good as the fiscally conservative choice for mayor of Houston for both Democrats and Republicans.

Equality Texas

I agree. We need more openly LGBT people elected to positions of responsibility to demonstrate that there is nothing inherently wrong with Gay, Bi, Tran people. This will help to change society over the long haul. I have already cast my ballot with Annise Parker's name on it.

CAUCUS TO MAYOR, COUNTY ATTORNEY: HOW CAN WE TRUST THIS ELECTION?

The Houston GLBT Political Caucus sent a letter to Mayor Bill White asking how Houston voters can trust that their voice will be heard when the election administrator, County Clerk Beverly Kaufman, has already weighed in on who she wants to win this election. The Caucus also sent a letter to County Attorney Vince Ryan, requesting an opinion on the legality of Ms. Kaufman’s continued administration of this election.

“Beverly Kaufman has not only stated her support of Gene Locke, she has been actively campaigning for him. What else is she willing to do to make sure he gets elected?” said Kris Banks, president of the Caucus. “We want our votes to be counted, and we don’t know if we can trust Ms. Kaufman to do that.”

The Caucus membership unanimously voted to send the letters at the October 7 meeting, upon a motion made and seconded by members.

“Although our organization supports Annise Parker for mayor, this is about the integrity of this election,” Banks said. “For the greater good of this city, we need to know that whoever wins the election won it fairly, and not have a redux of Florida in the 2000 presidential race.”

The Houston GLBT Political Caucus is the oldest organization in the South advocating for the civil rights of the gay, lesbian, bisexual and transgender community.

Chronicle Zogby Poll

The Chronicle Zogby Poll indicates that the adage still holds true. Council Member Peter Brown is the front runner – behind undecided, of course. Parker is running a tight second. Locke is a little further back while Morales picks up some support.

Here are their numbers, as reported:



* Not Sure/Undecided – 36%
* Brown – 23.8%
* Parker – 19%
* Locke – 13.1%
* Morales – 6.7%

The poll was conducted while the top three candidates had full media buys on the air – the week of October 12 – 15. They interviewed 601 likely voters and have a margin of error of 4.1%. The margin of error puts Parker and Brown within striking distance of each other.

Annise Parker Ahead

Houston, TX – The poll released today by the Houston Chronicle shows that months of round-the-clock ads and more than two million dollars cannot buy victory.

After spending more than two million dollars, Peter Brown is still in a virtual tie in head-to-head match ups with Annise Parker. John Zogby, whose firm conducted the poll, said that Brown “could be a little disappointed in these results, because whatever lead he has is hardly commensurate with what he has spent.”

The Chronicle also noted that Gene Locke, who has raised more than two million dollars, has been unable to consolidate a base and is “in a distant third.” Parker beats Locke handily in every trial heat.

This is a tough, tight election, with the future of the city at stake. It’s been close in all the polls from the start of the race, and it won’t be easy for any candidate. But now we’re in the stretch run. Voters are beginning to focus – and as they do, Parker will emerge as the candidate with the record, the character and the ability to be the trusted leader Houston needs.

Peter Brown is making a serious attempt to buy this election. He’s bought himself a lot of name ID, and he’s moved up in the polls. But as the Chronicle points out, in the head-to-head match-ups, “Brown’s lead withers to statistical insignificance against Parker.”

As Chronicle columnist Rick Casey points out, “given that [Brown] has had the airwaves to himself for a month, it’s hard to see how he lifts his total much above this in the next two weeks.” The bottom line is that all Brown’s money cannot blow Parker away.

Brown, however, hasn’t gotten the close scrutiny that the other candidates have. News media need to look behind the façade and start examining Brown’s lackluster record.

Senator Hutchison says she will resign her Senate seat by year's end. She is a late-comer to the new fashion in the Republican Party; -abandoning one's job.

There will be a special election to fill the Senior Senate Seat which she has occupied for 2 1/2 terms.

Kay Baley Hutchison is throwing her hat into the gubernatorial race and will battle fellow Republican Rick Perry in the primaries for the privilege. This will be a red-hot contest.

Houston Vice Mayor Pro Tem Sue Lovell won two endorsements from Democratic organizations this week in her campaign for re-election to Houston City Council At-Large Position 2.

Thursday night, the Harris County Democrats endorsed Lovell in a landslide vote at a packed meeting.

“Thank you Harris County Democrats!” said Lovell. “I can’t tell you how much it means to me to have the support of my home club - I can’t imagine running a campaign without the Harris County Democrats on my team.”

Lovell was also endorsed by the Oak Forest Democrats Wednesday night. “I am honored by this endorsement,” Lovell said. “And it is very exciting to see neighbors organizing to improve this great city.”

Sue Lovell is completing her second term as Houston’s City Council Member At-Large, Position 2. She also serves as Vice Mayor Pro Tem – a position to which her colleagues on the City Council elected her unanimously – and chairs the Council’s Transportation, Infrastructure, and Aviation Committee and Quality of Life Committee. Lovell worked closely with Mayor Bill White to pass the city’s budget that preserved vital services without raising taxes and added more police officers to the force.

Houston, TX – The candidates for mayor filed their finance reports today – and the big story here is Annise Parker.

Everybody thought Gene Locke would have three times as much money. But Annise Parker has more.

Because he has a limited base of support, Brown is having to spend his personal wealth to try to buy his way into the mayor's office. Let's remember, in 2003 Bill White started out with little name ID. That's the position Brown is in. It took White – who did have an actual base of support – $6 million to get into a runoff spot.

Bottom line – the big story is Annise Parker:

* Parker has more cash on hand than Locke.
* Parker has more than three times as many individual donations as Locke, and almost twice as many as Brown and Locke combined.
* Locke is spending almost twice as much money per month as Parker – simply trying to catch up to the substantial lead Parker entered the race with and continues to grow.
* Locke's campaign stated that the evidence of "campaign strength" was raising $383,000 in the last 30 days. But Parker raised more than that during the last 30 days. (If the last 30 days is the mark of campaign strength, it's worth noting that Parker raised 47% of her total contributions in the last 30 days of the period, while Locke raised 33% of his total contributions during that time.)


One thing is clear: Annise Parker is not only the candidate who started out with a strong lead – she's the candidate who continues to grow that lead. Parker's dollars were raised from more individual donors than any other candidate. Parker’s small dollar donors live on a budget, give wisely and will give again and again during this important campaign to steer Houston through tough economic challenges.

Thanks to all our Fort Worth and North Texas members who emailed Mayor Moncrief and all Fort Worth City Council Members to request an independent investigation of the raid by Fort Worth Police and TABC officers. Equality Texas members and supporters have sent thousands of letters to the Mayor and City Council Members.

Next Steps: With the Fort Worth Police Department and TABC conducting internal investigations of the raid on Sunday, June 28, 2009, and Mayor Moncrief asking the US Attorney to review the police investigation, it is critical that citizens of Fort Worth continue to demand a separate and independent investigation.

We are asking our Fort Worth and Tarrant County members, families, and friends to attend the Fort Worth City Council Meeting on Tuesday, July 14th. We need a show of support and solidarity from the Fort Worth/Tarrant County community to demand accountability and action.

EL PASO: CALL TO ACTION - CITY COUNCIL MEETING JULY 14TH

El Paso City Council Meeting Tuesday, July 14, 2009 at 8:30am

PUENTES LGBT RESOURCES will provide public comment in support of diversity training for local law enforcement agencies

Last Thursday, the ACLU of Texas and Equality Texas called for an official investigation into the El Paso Police Department's response to the June 29th incident at an area Chico's Tacos restaurant. "We’re extremely concerned that the actions of the restaurant employees and the El Paso police may have violated the law," said ACLU of Texas legal director Lisa Graybill. "The City of El Paso prohibits restaurants from refusing service to anyone based on their sexual orientation, and the police should have enforced that ordinance.”

Paul Scott, Executive Director at Equality Texas, noted that "While neither state nor federal law explicitly prohibits discrimination against LGBT individuals in public accommodations, the City of El Paso, like other major Texas cities including Austin, Dallas, and Fort Worth, went above and beyond to adopt an anti-discrimination ordinance that protects LGBT individuals. This makes what reportedly happened in El Paso all the more disappointing. Additionally, the continued reference to the unconstitutional sodomy statute by law enforcement officers is further proof that the Texas Legislature needs to repeal this statute and get it off the books." Next Steps: The ACLU of Texas and Equality Texas are working together on outreach efforts to help Texans better understand their rights. Meanwhile, PUENTES LGBT RESOURCES will be advocating for increased diversity training for law enforcement officials. PUENTES LGBT RESOURCES will be providing public comment at Tuesday's El Paso City Council meeting.

Action: You can show your support for PUENTES' advocacy efforts merely by your respectful presence in the council chambers. Equality Texas Calls on Fort Worth Members and Supporters to contact Mayor Moncrief and Fort Worth City Members for Immediate Investigation of Rainbow Lounge Raid on Saturday, June 26th.

Late Saturday evening, June 26th, Fort Worth Police Officers and Texas Alcoholic Beverage Commission (TABC) officers entered into the Rainbow Lounge in Fort Worth for an alcoholic beverage code inspection. What resulted was the arrest of seven (7) patrons, one being critically injured during the raid.

With the raid happening on the 40th anniversary of the Stonewall, we are reminded that we need to advocate for the equal treatment of all citizens and this case, we call for an immediate and public investigation into the circumstances surrounding this raid, including the apparent large number of police and TABC officers and paddy wagon. With one patron currently in ICU as a result of injuries sustained during the raid and arrest, the investigation needs to cover the use of excessive force and whether these injuries were the result of excessive force or were incidental to the arrest.

We ask Mayor Moncrief and all Fort Worth City Council Members to request a Public Investigation and to make a public statement. City Council member Joel Burns, District 9, has already issued a joint statement requesting an investigation. Statement on Equality Texas Blog HERE and next column. Equality Texas is in contact with Representative Lon Burnam's and Senator Wendy Davis' offices, and they have scheduled meetings with TABC to address these issues as well.

I am presently in Tucson undergoing medical treatment and had this sent to me. Normally I don't respond, but this is so absolutely absurd as to do nothing but cause damage to the credibility and effectiveness of the Caucus. Folks, get your facts right. If this "protection" is true in Houston, Texas or Harris County, why have we spent so much time, effort and money over the past twenty five years fighting this or that proposed ordinance? The HGBT Caucus has chosen terrific new talent in Kris Banks, why allow this kind of nonsense to undermine his and the Caucus' effectiveness in the future.....Personally, as bad as this is, as someone who lost many friends to AIDS during the epidemic, it is an affront to call this period a horrifying illness and it is a dishonor to those who lost their life because so many didn't care during this period.

We have three former presidents seeking election in November - Annise Parker, Sue Lovell and Lane Lewis - the Caucus should show leadership in what can and should be done. What does it do for hese candidates, former Caucus Presidents, that the organization doen't even know what the laws of the city are?





It is always welcome to see new thoughts expressed in new forums. This was just sent to me and I wanted to share this as an example of just being flat out wrong. Maybe the writer should understand that a blog is a place where you state a view of things and give your opinion. I'm not sure what it is called when you just out and out state false facts. A very simple check of past history and statutes and ordinances would prove that there is no protection from anything in Houston, Harris County or Texas. None.....zippo.....If the writer were aware of the world around him/her, he should know this, but for the writer to come from and supposedly represent the Houston Gay Lesbian Bisexual and Transgender Political Caucus is inexcuseaable if not down right criminal. I suppose I should expect nothing more from someon who sloughs off the HIV/AIDS epidemic as nothing more than a horrifying illness.

Let's talk turkey here, the under 30 group of Gays and Lesbians have no institutional knowledge of the struggles and personalities in the fight for equality over the years. They are more concerned with appearance and demanding than doing the long hard work to bring about change. For those who have been involved over the years, this has been a long struggle with more setbacks than advances. Folk who have done the legwork over the years know things don't just happen, they are made to happen and you don't just demand, you learn to work with people and you learn the parameters within which you can accomplish things. Success does not magically appear, more often disappointment is what the movement experiences....both in change of policies and laws but also in the elected officials, candidates and opinion makers who claim to be allies. Most of all it takes time to change puplic perception of anything. Ask a Black, Ask a Mexican...Chicano..Hispanic...Ask Asian Americans who came to this country. The leadership of the Gay movement both in political terms but also in service terms to the community did not suddenly appear one night. They learned to work together and formed alliances with those who were sympathetic to their plight. That sort of effort cannot be accomplished over night and the under 30 "leader" cannot just appear overnight and expect to inherit all the work done previously and take credit if they are not willing to work with all people almost full time.

The Gay movement, just like the women's movement, the Black movement, the Hispanic movement, the Asian movemment. cannot operate and be successful in a vacuum - it must reach out and bring others in if it is truly to be successful in changing laws and winning the hearts and minds of people. It takes work - it takes knowledge of what is and what has been - it takes more than what America and in this case Houston - sees as stereotypical behavior of GLBT's - it takes serious thought, planning and execution with behavior that is not alien to the majority.

Finally, change will come, but it wil not come because of the under 30 crowd if they continue as they are now. Telling the masses you can rent or feel safe in your job regardless of being Gay or not is just a flat out lie in Houston Texas today - unless your mommy or daddy owns your place and rents it to you or you work for a business owned by a relative who feels obligated to you. There are no protections in Houston, Harris County, Texas today. Yesterday's leadership well knows that with all their hard work, the movement has still not achieved all it can or should. Unfortunately, today, we seem to have to many folks who think they are the next Harvey Milk, yet they expect a title, they expect praise, they expect "leadership" and they don't know what needs to be done or how to do it and many seem unwilling to do the heavy lifting...instead it's lets go for drinks and talk about who we are going to outmaneuver next.

Election of openly GLBT candidates is not the answer to all the problems. Once they are elected, what is it they are supposed to work towards? Who is going to hold them accountable? Look at the history of Houston GLBT's and find your answer. To be a leader, you must earn that distinction and the first qualification is to have people follow you and the second qualification is to actually accomplish something. New bllod is great and it is essential, but to quote my momma, "you don't throw the baby out with the bathwater" and you damn sure don't discard or disregard the old.

Please don't make everyone who has worked too had over the years for equality in this city look foolish by not knowing what you are talking about. At least spend as much time learning what has been done, by whom and what can be done in the future as writing so as to see your name in print to salve your ego - even with false facts. Sometimes it is better to stick to those things you can do well - once you figure out what that is rather than being the know it all, be all to end all. The Gay movement is too important and there are too many to honor to do things like this silly false fact spreading blog.

While I don't know who the author of this piece is, I do know my history, I do know this city and its people and I do know my facts...I have lived them for near forty years of activism and I sign my name to what I think. It has just been announced that they are now keeping the Caucus Blog updated, I pulled up one paragraph stating that gay people can freely rent apartments and can be openly gay at work. What planet or what state do they live on.
We have no protection in Houston, Harris or Texas.

Today we can freely rent apartments, be openly gay at work without fear of being fired, and for the most part exist free of shame and trepidation. Gay youth feel comfortable coming out at a younger age. The GLBT community has made its way into the mainstream of American culture. Gay characters commonly appear on television, though it was just twelve years ago Ellen DeGeneres’ coming out episode was banned from several stations and was preceded by a parental warning before airing. Opponents of gay rights and gay equality are fighting a losing battle. Being gay is not a divisive issue with my generation. Given that it is easier to be gay these days, it can sometimes be difficult for younger GLBT people to identify with with the struggles of the past generations of their community. Many young people may not have heard of the Stonewall riots, they may not have heard of Paul Broussard’s murder, they do not know what it is like to lose dozens of friends to a horrifying illness, and they do not know what it was like to live in fear of merely being who they are in public. Recently, this is where complacency has taken hold in the gay rights movement especially with GLBT youth. However, acceptance and toleration are not equality. The recent set backs, such as state constitutional bans on gay marriage and the Prop 8 fiasco in California, have proven that there is still a long battle ahead. There is a buzz in the community that many have not felt in a while. Many of us, who have grown up with it being acceptable to be gay, have had their eyes opened to the fact that we are still not equal, and realizing we have laws of our country, our state, and our city affirming that we are not equal. Living a life being tolerated or accepted is not the same as living as an equal member of society. The complacency is now being thrown aside.

Texas v. California

Why Texas isn’t like California.

I recently read a Truthout article on the ideological divide in California. They had a special election May 19th. There were six budget propositions on the ballot. If they didn’t all pass, it was claimed, Armageddon would ensue.

Pencil Armageddon into your day planner, California.

Five measures involving nominal tax increases (it could be argued they were more money shuffling than net increase) failed to pass.

The measure capping compensation for legislators during budgetary challenging years was enthusiastically approved by the electorate that showed up that day. It was the lowest election turnout in history.

Apathy, anger, atrophied...Armageddon.

The California budget deficit is now 21 to 24 billion (U.S. dollars), depending on who’s counting, now that the compromise, as outlined in the 6 ballot measures, has failed.

It’s a lot of hard work by the Legislators down the drain; into the San Francisco Bay as it were. This is the same bay Alfred Hitchcock’s Kim Novak throws herself into in the movie Vertigo.

Back to legislating.

There is a philosophical divide in this giant petri dish called Cali-for-ni-ahhhhhh; a word recognized in many languages worldwide.

Texas; let us behold in horror so that we do not become what we fear. We have been provided an example of what not to become. And how to not be it?

Lets channel Kim Novak; she’s two different people.

They have machismo in their gobernador, Arnold Schwarzenegger. This is the body-builder turned actor; un gran actor, el señor Schwarzenegger.

Lets look at the resumé that has prepared this Schwarzenegger to lead the world’s 8th largest economy. Is this Spain before the Armada? The ships that sailed, they didn’t come back.

I hope this will serve as a cautionary tale for those who dismiss complaints regarding Sarah Palin’s slender qualifications as mud-slinging from fringe Obama supporters.

It is more than just prop 13; that grand property tax scheme where you pay many times more in property tax than your next door neighbor whose property is worth exactly the same as yours but he had the good sense to move in 2 decades ago while you were stupid enough to buy your house last year.

You are dumb.

It is more than high sales tax rates which are regressive because the incomes of poor people largely go to buy necessities such as diapers for their babies, etc. The rich don’t go to Target, thank you very much.

Or should I say Targé?

It is a budgetary process that is tied in knots due to micro-managing by a plebiscite; the villagers who show up with pitchforks and flaming torches to scare Mary Schelly’s Frankenstein back into the castle.

How does one govern a state not quite as large as Texas?

How not to do it.

Hamstring the ability to collect property tax in a fair, impartial, systematic, and predictable way.

Á la Prop 13.

Then hard-wire (mandate) diminishing funds for pet projects.

Add a dash of extreme gerrymandering so that only the fringe of each party shows up to the primaries to place ideologically immovable and uncompromising legislators in power.

And there you have it. The state Texas does not want to become. This is a negative example to be sure, but still, we can learn from it.

Harris County has offered to host a short business meeting and a FUN

Annise Parker for Mayor Releases Plan to Modernize Houston’s Infrastructure

Parker:
“Maintaining and upgrading our aging infrastructure is more than just a problem to solve – it’s an opportunity to create good, local jobs that will power our local economy while responding to pressing needs.”

HOUSTON, TX - Today Annise Parker released her plan to modernize Houston’s infrastructure. Parker offered the plan, entitled
“Engineering a Stronger Houston and a Healthier Economy,”
as part of her campaign for Mayor of Houston.

“A failing infrastructure cannot support a healthy economy,”
Parker said, quoting Wayne Klotz, president of the American Society of Civil Engineers, and a supporter.

“In today’s economic crisis,” continued Parker, “we are seeing that maintaining and upgrading our aging infrastructure is more than just a problem to solve — it’s an opportunity to create good, local jobs that will power our local economy while responding to pressing needs.”

Parker cited a Congressional Budget Office estimate that every dollar of infrastructure spending can boost the economy by up to $2.50.

Parker’s plan calls for a dedicated funding stream to pay for upgrades and maintenance. “In this tough economy, our first goal is to work within existing levels of revenue,” said Parker.

The plan relies on federal stimulus dollars in the very near term to supplement existing funds. Over the long term, Parker wants to use tax dollars now going to tax increment refinancing zones, also known as TIRZs, once the zones complete their project plans. Those tax dollars would otherwise be returned to the city’s general fund.

Acknowledging that the numbers in the near term are modest, Parker said, “As the economy improves, we will have the financial bandwidth to consider new ideas. But today, it is important to make a downpayment on our future.”

Parker’s plan also calls for an infrastructure audit – a comprehensive needs assessment – and the creation of a long-term infrastructure plan with a five-, ten- and twenty-year horizon.

“The short-term interests of politicians who can serve only six years may not coincide with the long-term planning necessary to maintain and upgrade our infrastructure,” Parker said.

Due Process

Dear Reader:

Apparently, back in 2005, a Texas constitutional amendment was passed. It was called proposition 2, and it was sponsored by Rep. Warren Chisum. This amendment did two things:

• Prop 2 amended the state’s constitution to ban same-sex marriage by stating that: marriage in this state consists only of the union of one man and one woman.
• Prop 2 amended the state’s constitution to prohibit: creating or recognizing any legal status identical or similar to marriage.

So, Texas will not recognize a same-sex marriage performed outside of the State. The following is from the Texas constitution:

Sec. 32. MARRIAGE. (a) Marriage in this state shall consist only of the
union of one man and one woman.
(b) This state or a political subdivision of this state may not create or recognize
any legal status identical or similar to marriage. (Added Nov. 8, 2005.)

Traditional marriages, as we are all aware, are recognized (traditionally) across state lines. Usually, a marriage performed in one state is recognized in another. Obviously, same-sex marriages performed in other states will not be recognized in Texas.

In Other News:

Loving vs. Virginia was a landmark U.S. Supreme Court case decided in 1967. (One year after my birth.)

In Loving vs. Virginia, decided June 12, 1967, it was decided that a law preventing inter-racial marriage was unconstitutional. ‘This does not seem relevant’, you say to yourself. But, how was this conclusion reached? Was it because all racial matters must be applied equally? Is this from the Bill of Rights at the Federal level?

What do the Equal Protection and Due Process Clause of the Fourteenth Amendment mean? Perhaps answering this question is an ongoing process.

“Virginia's statutory scheme to prevent marriages between persons solely on the basis of racial classifications held to violate the Equal Protection and Due Process Clauses of the Fourteenth Amendment.”

In Fundamentals of American Law, by Alan B. Morrison, the Equal Protection Clause is explained to have “evolved into a broad charter of equal treatment that reaches beyond race to protect women, aliens, illegitimates and other ‘discrete or insular minorities’ who have historically been short-changed in the political process.”

“The freedom to marry has long been recognized as one of the vital personal rights essential to the orderly pursuit of happiness by free men. “ - MR. CHIEF JUSTICE WARREN in the delivery of his opinion in Loving vs. Virginia.

In my opinion, and I am not a lawyer (as you can surmise by my writing), the statute in the Texas constitution (passed by the voters) seeks to deny a certain group a given essential right without due process. The state of Virginia sought to prevent inter-racial marriages and it was found to violate the Equal Protection and Due Process Clause. These clauses would seem to apply even if race is not a factor.

In June 1958, an inter-racial marriage was performed in the District of Columbia "pursuant to its laws." The Lovings returned to Virginia "and established their marital abode in Caroline County.” I read this in the summary of Loving vs. Virginia. I am paraphrasing. This is now history and we now take for granted the legality of inter-racial marriage. We take for granted that states cannot regulate the inter-racial marriages away...without...Due Process?

"Almighty God created the races white, black, yellow, malay and red, and he placed them on separate continents. And but for the interference with his arrangement there would be no cause for such marriages. The fact that he separated the races shows that he did not intend for the races to mix." -trial judge quoted in the summary of Loving vs. Virginia. Read the decision. It fills one with hope.

Onwards...

“Other central provisions in the Virginia statutory scheme are 20-57, which automatically voids all marriages between "a white person and a colored person" without any judicial proceeding, 3 and 20-54 and 1-14 which, [388 U.S. 1, 5] respectively, define "white persons" and "colored persons and Indians" for purposes of the statutory prohibitions.” -again, from the summary of Loving vs. Virginia.

This would seem to be in essence how the Texas constitution voids marriages performed outside the state that would not be recognized within the state...without due process; automatically. Texas negates marriages with the stroke of a pen.

Is the absence of due process only a problem when it applies to different races? Are we all entitled to due process?

Due Process: The In Thing this Season.

Does the Fourteenth Amendment apply when states deprive any person of life, liberty, or property without due process? It would seem that the states cannot deny any person fundamental rights without due process. The original Bill of Rights (Federal) is made binding on State and Local governments.

Beginning with Gitlow v. New York, states were not only constrained by their own Bill of Rights, but the Bill of Rights through the conduit of the 14th Amendment.

"Indeed, the rightward tilt of the state's GOP electorate permitted another Tea Party insurgent to mount a respectable run without serving as a spoiler to Perry's similarly themed campaign. The rightward slant of the Republican party in Texas portends ill for its citizens and residents alike. A state already gerrymandered to the Republican's advantage, allowing a comfortable margin for incompetence, is being pulled toward a radical part of the political spectrum.

The Tea Party rejects any workable form of federalism where the Federal government plays a necessarily central role in funding large projects, such as roads and dams, and provides funding for necessary functions, such as public education.

"But by the time Republican voters went to the polls here in a primary on Tuesday, the political ground had shifted under Senator Hutchison, who lost in a three-way race to Mr. Perry." -link to NY Times Article.

The Tea Party candidates posit themselves as outsiders. But, Rick Perry has been governor for over 10 years.

If you really want change, elect someone who hasn't been governor for 10 years. Bill White handily beat several other Democratic challengers, and, Bill White doesn't have to hide under a false agenda.

The Tea Party is a mis-informed tax revolt married to a wild-eyed dream of secession. All States require federal money to complete big projects because this is the tax money not hijacked by regional petty thievery, and, back-stabbing. It provides the wealth to the communities too poor to educate their own children or pave their own streets. And it provides a necessary counterweight to local lapses in judgment.

Don't leave the future of Texas in the hands of a movement that would send us back into the Dark Ages; where a decent education is a luxury, and a decent life is a far-off dream. This is the movement that would deny you your unemployment benefits. In fact, Governor Perry already has.
